    You had better obey frontier immigration and customs controls or you will be "free thinking" while blindly obeying "bend over" orders in prison.

    Smugglers and illegal immigrants are dealt with harshly and officials like to collect money.

    You may dream of the freedom of the seas, a nice dream, but that dream disappeared decades ago.

    'US' is yachty's and the members of this forum that you have decided to come here and ask for ways of getting round laws of the sea.

    Instead of trying to falsify documentation or get out of it I strongly advize you to do it correctly.

    Sorry I am unable to teach you how to cheat the system.

    To risk your boat and wife and kids in this way is beyond me. It is people like you that drag yachtys name down.

    I hope you and your family like prison food.

    He recalled the cuffs were tight around his wrists as the Customs tightly lashed his boat to a stone fishermans warf, it bounced hard into the cement wall and they laughed when he asked for fenders to be used.

    Even though the cell was dark and it was night it was still hot. The moon shone through the bars as he sat on the floor with his back to the wall. cockroches moved around like a moving tapestry and the stench was eye watering.

    He could hear is wife crying in the next cell but would not return speech, where the kids had gone he had no idea.


    He wondered if he would ever see his boat again or if it would still be afloat as he once more heard his wife cry out.

    One thing he remembered was the advise from frosty the grumpy old git from the boat design forum , how he wished he could turn back the time and get a proper ships registration.

    No big deal. This is a very common practice and there are bankers and accountants that will set this up for you for a small cost and list themselves as the coowner/stockholder. The bankers probably are listed on hundreds of cos. You indemnify them against liabilities and they stay out of your business. It's usually worth having them file the annual corporate report for you, but I would recommend that you do the boat registration for yourself. You just have to find one acceptable solution and run with it. Don't try and sort out the whole world's problems.

    Good luck with that attitude if you sail into Australian waters. I hope you keep enough spare money to build a new boat after you get out of jail and are deported.

    I don't believe in obeying laws just because they're laws either but one needs to temper this attitude with some realism. Australia patrols its territorial waters closely via aircraft and your chance of laying up somewhere undetected are very small. The penalties, OTOH, are not small at all.

    I'm with Frosty. Yacht owners travel by sufferance not right. Abuse clearance and documentation procedures and you *are* crapping in everyone's nests.

    You will have to register it somewhere,may as well benefit from the process.

    Foundation owns bearer share corporation,which owns the vessel.
    You are the captain,run the vessel as an IBC,use the bsc to invest and open bank/trading accounts.

    I'm constantly travelling the world since 15 years +; and i did see them guns everywhere indeed.
    big guns, small guns, all kind of guns meant to scare us and to kill us.

    but in fact those guns bearers are the one to obey : i come with the right knowledgeable speech or required paper that bends their rules to my advantage whenever i need to or decide so & they obey me.

    been to jail ? never.
    got the red carpet ? mostly, even in Burma when they found me walking around those forbidden tribal villages the junta don't want the tourists to see.

    thanks philSweet & WestVanhan for sharing your knowledge... but maybe i don't understand what you are saying philSweet : if i do boat registration for myself, then no company, then no possible register in india then only offshore registration possible.

    PT stands for pro tempore ?
    pro tempore for ever, tax or vat for never ? it's more or less the delaware principle but at the next level ?

    Be aware that commercial .. as a company... registration carries many burdens and brings your paperwork under scrutiny at every frontier.

    Something to remember is that private cruising yachts are an oddity to many officials. Officials only know commercial shipping . You do not want to be confused with a commercial enterprise or you will be living in a world of shipping agents and paperwork.


    Far better to be registered private yacht, WITH YOUR NAME ON THE PAPERS, have a camera around your neck and when asked by authorities what the purpose of your visit is simple state... TOURISM ...to have fun and enjoy the country.

    British flags of convenience are prefered for their versatility. US flags are a burden when operating worldwide.

    As far as I know its possible to fly the French flag and be non VAT paid if you operate outside the European Union. I see many MALTA flags these days ?

    Consult a specialist.

    Frosty, you can lead a horse to water, yopu cannot make him drink.......I guess we can bring him a glass full when he need it eh mate.

    It is such a simple thing to do to officially register the vessel that I cannot see for the life of me why someone woulkd try that hard to buck the system, Customs and Immigration everywhere that I have been have been polite (still a pain in the arse, but they try to be nice if you are that way inclined). Upsetting them from day one sounds like digging your own hole I reckon.

    Exactly,--he will fill out no more forms doing it right than doing it wrong. The fines he will pay will exceed the amount of a reg slip.


    I think he's a fugitive on the run, no other reason to be so desperate.

    Unfortunately the " Cruising Fraternity " is notorious for not abiding by rules. There is a situation locally. Multi hull anchored outside the harbour...anchor broke free and the multi blew ashore. This Cruiser had no insurance and no paperwork...the big mess on the beach is left to the locals to clean up.

    Documents and insurance are required in every country I visit.

    The reason is logical.... Who is responsible for the boat ?

    I haven't read all the posts, but what I see is that you are not a free person even in your own country. They have to have a clamp around your nuts to keep you in line - right after taking your money.

    I wonder if they are afraid you would 'escape' when you leave with the boat ?
