not sure what I'm going to do at this point

    Its a good idea, mostly if you go against the broker, for sure this one will not want bad publicity, so he will work for you to save his reputation.
    Just an idea.
    The other is let it go as Troy was saying I think, and concentrate in the research for your boat.
    I understand the 125K is far to much money, but they have some good second hand. Lets face it this Elco is for sale now for 5 years (I think it is this one or a sistership), changing brokers all the time. They will never get this amount.
    I saw a 50' Trumpy to be given, so the family can get rid of it and the expenses after the owner passed away. (but a lot of work)
    What you see on brokerage firms, and what is behind is very different, mostly on old wooden boat.
    Its buyer market, sellers are in bad shape. Smile in front, foreclosure behind :D
    Keep going, don't loose the faith :)

    ya rule of thumb seems to be 1/2 the asking price so that 125 becomes 60+ which is still a ton of money

    if its going to cost me that much I will need to save for another year or so and even then I'll be hard pressed

    frankly I'm not sure I'll last another second at this screwed up job of mine

    I think I want some satisfaction out of this guy in Oregon for selling my boat

    deal is they pulled a fast one on me and I'm not inclined to just get screwed and not even try and do something about it

    I'll play with him for a while till the lawyer tells me something definitive then I'll make a decision from there

    do you know the lawyer, remember he is a small business and you're a paycheck, so keep an eye on him too

    nah I had to get one in Oregon and he seemed to know this guy who sold me the boat, not sure if this is going to help or hurt but he was the only lawyer I could find after a morning of searching that had time to handle the case.

    I was after all interested in an injunction against the sale until I heard what it costs

    well I just got off the phone with the lawyer and as far as he is concerned I owned the boat from the moment I accepted there offer

    looks like I do own a boat

    now to find out where it is

    Ok here's the deal

    I have a valid contract and I own the boat

    but

    it will cost 2500 to file for the boat through my attorney

    the lawyer says I would most likely end up with the boat and my fees back except for the filing fee's

    he also says this guy I'm going up against is a pretty big fish in Portland and would unlikely enjoy being raked across the coals like this publicly

    The fact that he has sold the same boat to two different people means there are a few additional issues which are not all that easily explained
    at least not by me

    deal is do I want to pay 9500 for the boat and have to wait a year or two to get it

    I told him I'd think about it and give an answer in the morning

    bottom line is

    the boat is mine if I want to pay the legal fee's to recover it

    Let your lawyer write a harsh letter to the sellers and explain what their chances are.

    Likely (?) they are to deliver the boat without legal action.

    Cost would only be the letter of the lawyer.

    The letter coming from your lawyer will let them know your willing to play ball.

    If it don't work out that way you can decide what to do afterwards.

    Well, that's still a good price for the boat, I think. And I doubt it'll take a year; my guess is that the broker and the church will settle when they come face to face with lawyers. The broker to keep a blot off his license, and the church to avoid bad publicity.

    It will be very interesting to find out who the other buyer is. If he (or she) is a friend of the broker, or connected to the church in any way whatsoever, your lawyer can start talking about collusion....

    there is the mater of possession
    this other guy has the boat and is altering it as the suet goes through the system
    unless I get that injunction
    which is another 5k on top of the 2500 filing fee
    so my boat does not exist as it was sold
    and to ensure that it does exist as it was sold costs the same as the boat itself
    assuming I would not get costs
    which in the state of Oregon under this type of filing I could assuming I won
    it gets really messy and it would take about a year assuming this guy wants to play
    which he has stated he does but I dont really believe him

    I appreciate all the input
    your thoughts on the mater are invaluable as always
    I'll be reading along and will decide by tomorrow what I want to do
