not sure what I'm going to do at this point

    guy just wrote me on that old elco flat top
    says its still around and "available for the asking"

    could get interesting
    depends on what it costs to move it

    am looking forward to talking to the lawyer today
    not sure how they think they can reject there own offer to me in writing that I signed and then included a check for
    who knows
    maybe do own a boat and they just dont realize it yet

    think about an injunction or something about the boat being in the same condition as it was when you should have gotten it

    or they have to make it right at their expence

    I looked into the injunction and the lawyer said that those are really hard to get and cost about 5k

    my bet is they got the boat out of there fast as they could but the issue remains of whether I owned it and when. Chances are that I owned it from the date I signed the check in which case they sold my boat without my permission. Could also be I owned it from the time I signed the contract which results in the same outcome. Could be from the time they cash the check in which case I'm out a boat or could be from the time they recieved proof of my having done both in which case I'm back to owning a boat.

    whole thing is a mess and it almost seems like it was designed to be that way. No clue what the benefit to them in this whole thing is but I'm likely to find out if I dont play this right

    ya there are plenty still around but that 125k price tag is pretty standard, many are up in the 200-500k range

    wouldn't it be from the time they sent you the offer?

    and if you sent it back in a timely fashion

    one out they could claim is that several offers were made to several people with the stipulation that the first response got it

    was it a firm offer without any stipulations?

    sure was and I answered there offer first
    like about a week ahead of the "other guy"

    at what point I actually owned the boat is kinda key here but its hard to find a logical reason why I didn't at some point

    they got the check and they got the signed contract

    they claim they sent it back but I have yet to see it

    I canceled the check though so its no big deal either way

    no they were in a huge hurry so I sent it on a Sunday and the place to send registered was closed

    the more I think about it the more of a scam it would appear to be

    I sent it good old US mail
    har har har

    but I also scanned both documents and sent an e mail containing both on several occasions

    I offered to wire the money if it was a problem and they declined

    my bet is they got the letter in a few days but were negotiating with this other person and wanted a way out
    so they claim it never got there

    doesn't matter according to the lawyer but he's still looking into things as we speak

    It's time to apply pressure Dan. Settlements don't come to those who wait, they come to those that threaten damaging whatever. It forces them into a simple business decision, "do we want to have all this negative attention, just to settle later" or "do we settle now and avoid all this negative attention".

    well its before office hours yet in Portland so I'll just have to be patient a while longer

    I did hear back from the guy who sold me the boat and he's trying to say it was my offer they rejected, but I can prove otherwise. So how this is going to pan out is anyone's guess
