Sounds like a minor manufacturing defect - the shift shaft seal of the lower unit shouldn't go bad esp. if new 6 months ago.

no the leak looks like it is coming from the top gear case or the bell housing shift shaft could that be ? is it something the shop should have done when putting together

It's been a year since I pulled an alpha off last. If memory serves, the shift cable end from the transom assembly rides in a slot in the upper unit. That is transferred by a rod with "U" end to turn the shift shaft. That shift shaft "L" comes up through the upper unit plate, but the shift shaft oil seal is on the lower. Unless I'm misremembering, the lube may be coming from another place and only collecting on the shift cable. How much lube is leaking out?

No rollyh, the shift shaft comes nowhere near the upper gear case.

Oil can leak from 2 places only: the upper seal around the drive shaft or the oil passage between the upper and lower case, where the should be an O-ring glued to one of the two surfaces prior to assembly.
