Just spoke to a lawyer and she says theboatis mine and they are in breach of contract

Not so sure just discovered I have to go through Oregon courts

Also it's likely offer and acceptance which means that if they didn't cash the chichi it not a void sale

Although they made the offer and I accepted and confirmed with my signed chech

Whole thing is bull ****

It would appear to me you have illegally sold a my boat
I will initiate legal action unless the boat in question is immediately remanded to me for the agreed price

That is too bad. If your lawyer gets off a letter quickly letting them know you are coming after it you might get your way if they (owner and broker) know they are wrong. Otherwise, you may as well save your money and put it towards the next one you find.

Not sure on your contract law but the consideration was the money was this written in to the contract?
If so can you prove they received the check?
The contract should have mentioned what kind of payment and did it mean cleared funds?

well I'm just baffled how I can have a signed contract by the broker/agent and by me and payment made and they can just sell the boat out from under me like that

its just doesn't feel legal at all

something really fishy is up with this BS

They are claiming they have not received the check which is a cashiers check

they have been sent scans of both the check and the signed contract which included the signature of there agent

whole thing is BS

what more bad Carma could you ask for

Suggest it's time to go to the news papers and local news TV stations and offer the story up for them to air. This is one of the quickest ways to get people to yield to your desires. A church or business can't tolerate this type of "exposure" particularly in these economic times. Also find the churches "national association" affiliation and call them asking if this is the way "all of their churches operate". The result will be pressure from three sides, local news papers, local TV news and the national association. They'll come begging to settle this issue, trust me.
