| Pavel, PLease cancl that request. The source code is in fact included in the installation. He has gone through some trouble removing all the references to FREE!ship from the program. The fact that the GPL license is not included in the installation (nor any reference to it) can be used aginst him though. |

| Hi Martijn, I'll post them a message asking for the source code, but I imagine I'll never get it, and I doubt I'll get any reply from them. About your second question, the answer is no, what you get is what you see (I cut&paste all the links from their download page). the direct link to their download page is the following: http://www.3dboatdesign.com/memberen...php?item=3&cbr it should work for you as well. If it doesn't work, just tell me and I'll post you privately the PDF. I hope you'll be able to prosecute them. Kind regards Paolo |

| The GPL does not prohibit a distributor from charging money for software covered under the GPL. It does, however, require that any program containing GPL-covered code be licensed, as a whole, under the GPL, and must contain a prominent notice to that effect. Thus, although a distributor may charge a fee for his services, anyone in possession of the executable or source code can give it away to whomever they like. Technically, one could apply this argument to DELFTship as well. However, I view the situation in that case as being more akin to dealing with a big enterprise Linux distributor- you're paying for the assurance of ongoing bugfixes, support, testing, research and development, because you want the software to stay current and stable; major corporations worldwide have recognized the benefits of following this pricing model even though Linux is under the GPL. And Delftship has a free version; from what I understand (correct me if I'm lost, Martijn), much of the paid-for Pro functionality is in the form of separate modules that, although they communicate with the core program and can be accessed through the same interface, are not actually part of it.

| Update After examining the source code it seems that all references to the GPL license (including the GPL license itself) are removed. I've just send Andrew Casey another mail to ask him what he is going to do to correct this. Marshmat: Since I'm the sole developer and have the copyrights that pretty much leaves me free to use the code in whatever way I want to. And yes, all the added extensions are new developments. |

| And my small contribution too. I sent them an email asking whether that was just a freeship. Here's the answer (with their misspelling freeTship): "Our customer support team personnel has replied to your support request #763690 Hi, Thanks for contacting us. To confirm for you, this is not freetship. 3D Boat Design is a software program that has only recently been released (2009) It is a full legal copy, not a bootleg, nor illegal. It is also fully functional. No trial, no time limits etc. If there is any thing else we can help you with please let us know The 3DBoatDesign.com Team We hope this response has sufficiently answered your questions. If not, please do not send another email. Instead, reply to this email or login to your account for a complete archive of all your support request and responses." They think it is their "original" work. |

At times, we may reverse a sale in order to comply with: credit card industry rules, ACH industry rules, PayPal terms of service, US law, and requests from verified US judiciary or law enforcement agents. Martijn and Pavel, make noise with them (but I still like the idea of letting the neighbours in those nice neighbourhoods do the job better ) Mikey |

| He is advertising with Google, they have a trademark complaints page here https://services.google.com/inquiry/aw_tmcomplaint or email ads-trademarks@google.com From what I have heard, it is actually not difficult to get advertising withdrawn from Google if advertisers break the law As address I would use the work address at the University Mikey |

| Just to keep you updated, ClickBank refunded my purchase. I don't know if this will have any effect on his relationship with the ClickBank.net accounting, I hope it will. Paolo |
