What are the rules about being allowed to hoist a tender in the water with people in it. Or where can I read more about it?

Do the rules make a difference between crew and guests?

Is it a matter of (extra) capacity of release mechanisms?

Any feedback is welcome.

The rules depend on the country. In general hoists that lift people have more stringent rules and usually have to be certified.

Well, we plan to have the crane certified as a yacht crane (Lloyds/MCA) but I guess certification to lift people is different from lifting just a boat or a boat with a crew member.

But since the crane will have a 10 ton capacity , I wondered if is a factor in approving it to host a tender with people in it (say 2-2.5 tons max.).

No. Lifts for people have special certifications.
