Marina liens On Boat

my interestes is that i like to know more info on dockmaster and there power to place liens on boats and the process.

OPENWATERS...could you mean liens? The legal right to sieze, restrain, or sell goods or property in lieu of unpaid claims?

I am sorry, I don’t think anyone can answer that question with out more information. The law is different in each state of The United States and I would think in each country. The reason that you can use to take possession of a boat is also not very straightforward. In some circumstances you have a “warehouse men’s lien” in other situations you have a “garage men’s lien” and then some times it falls under the states abandoned property law. Each of these is very different in what you can do and how long it takes.

The best way to get the title if the owner owes you money is to offer to forgive the charges if the owner will sign over the title. We always told the owners of abandoned boats that we would start an action in civil court if they didn’t remove the boat, pay the bill or sign the title over.

It’s almost never a case of salvage under the maritime law, even if you raise the boat from the bottom. Unless it’s a very odd situation stay away from the Federal courts, they will hear all maritime cases. They are the most expensive games that you will ever play.

If you are involved in a situation with a boat now, it is worth considering the “bailment” that you create when you have what they call “care, custody and control”. There are some things that you can do that will make you responsible for the well being of the boat. If you are not careful you can be stuck with some big bills and you might not end up with the boat.
